By accessing or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into contracts.

2. Accounts

You are responsible for:

  • Maintaining account security
  • Protecting API keys
  • All activity under your account

3. Service Description

FormSentry provides a spam filtering API designed to assist in detecting unwanted form submissions.

The Service is provided on an “as is” basis.

4. Subscription & Billing

Paid plans are billed in USD.

Free plans are subject to usage limits.

We may suspend or restrict accounts exceeding plan limits.

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes
  • Interfere with platform operation
  • Attempt unauthorised access
  • Reverse engineer detection systems
  • Submit malicious or harmful payloads

6. Data Ownership

Customers retain ownership of submission data.

You grant FormSentry permission to process such data solely to provide the Service.

7. Aggregated Data

We may use anonymised and aggregated data to improve the Service.

8. Availability

We target 99.97% availability.

This is a target only and not a contractual service-level agreement.

We do not guarantee uninterrupted or error-free service.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

To the maximum extent permitted by law, we disclaim all warranties, express or implied.

10. Limitation of Liability

To the maximum extent permitted by law:

  • For paid accounts, liability is limited to the total fees paid in the 12 months preceding the claim.
  • For free accounts, liability is limited to USD $50.

We are not liable for indirect, incidental, consequential, special, or punitive damages.

11. Indemnification

You agree to indemnify FormSentry from claims arising from:

  • Your misuse of the Service
  • Your violation of applicable law
  • Content you submit

12. Termination

We may suspend or terminate accounts for:

  • Breach of these Terms
  • Abuse of the Service
  • Non-payment

You may terminate your account at any time.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

14. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control.
